- Purpose and Scope
This Cancellation and Amendment Policy outlines the terms regarding cancellations, postponements, modifications, and payment adjustments for services provided by SC&P CONTRACTS LIMITED.
We provide groundworks, earthworks, drainage, site preparation, and plant/machinery hire services for commercial and construction projects in Northern Ireland and other agreed-upon locations within the United Kingdom.
This policy applies to quotations, project deposits, confirmed service orders, written contracts, installment payments, and equipment hire agreements entered into with SC&P CONTRACTS LIMITED. Please also refer to the relevant quotations, order confirmations, and signed project agreements.
Where a separate written agreement contains different terms regarding cancellations or amendments, those terms shall apply to the extent permitted by applicable law.
- Website Pricing and Project Deposits
Prices displayed on this website represent project deposits only and do not constitute the full contract price for the associated works or hire arrangements.
The deposit amount, payment schedule, scope of work, and the balance due will be specified in the relevant quotation, invoice, or written agreement.
Payment of a deposit does not signify that the project has been paid for in full, nor does it imply that any additional work is included in the agreed price.
The remaining project balance, installment payments, equipment hire charges, and any agreed-upon additional costs must be paid in accordance with the applicable payment schedule.
Clients should carefully review all quotations and written agreements before making any payments. If the scope of work, project timeline, or pricing has not yet been finalized, both parties must confirm these arrangements in writing before any work commences.
- Client Cancellation Requests
Should a client wish to cancel a confirmed project, scheduled service, or equipment hire arrangement, they must submit a request in writing to projects@scpearthworks.com. A cancellation request must include the client’s name, the project number, the relevant quotation or invoice number, the services involved, and the requested date of cancellation.
Cancellation requests will be processed in accordance with the applicable contract and the specific circumstances of the case. Clients should not assume that the submission of a cancellation request automatically terminates existing contractual obligations.
If both parties agree to the cancellation, they shall confirm the effective date, any outstanding contractual obligations, and the handling of payments already made.
- Project Deposits and Cancellation Fees
Upon the cancellation of a project, the treatment of any project deposit will depend on the agreed-upon contractual terms, the work already completed, costs reasonably incurred in preparation for the project, any commitments made regarding equipment or labor, and applicable legal requirements.
Should a client cancel a project after the commencement of project preparation, mobilization, site surveys, material procurement, equipment allocation, or the actual start of work, SC&P CONTRACTS LIMITED reserves the right—to the extent permitted by the contract and applicable law—to charge for work completed, services rendered, and reasonable costs incurred as a result of the cancellation.
Any cancellation fees must be consistent with relevant contractual rights and applicable legal requirements. Deposits are not automatically considered entirely non-refundable in all circumstances.
If the amount already paid exceeds the amount due following the cancellation, the difference shall be refunded in accordance with the applicable agreement and legal requirements. If any balance remains outstanding, the client shall pay such amount in accordance with the agreed-upon terms.
Nothing in this policy shall exclude any rights to a refund or other entitlements that cannot be excluded by law.
- Changes to Project Scope
Should the client wish to modify the scope of foundation works, earthworks, drainage, site preparation, or the rental of plant and equipment, a formal request must be submitted in writing prior to the commencement of the relevant site activities.
Requests for changes may pertain to matters such as site conditions, quantities, technical specifications, site access arrangements, plant and equipment requirements, construction dates, project duration, or the established sequence of operations.
SC&P CONTRACTS LIMITED will evaluate the request and, where necessary, issue a revised quotation or a written change document, detailing the adjusted scope of work, pricing, payment schedule, and updated completion timeline.
Any significant change shall only become effective upon written confirmation by both parties. During the period in which the parties are negotiating the scope and commercial terms of a change, site activities affected by said change may be suspended.
Where a change results in an increase in labor, plant rental, transport, materials, or on-site personnel requirements, or extends the project duration, additional costs shall be payable in accordance with the terms agreed upon by both parties.
Where a change results in a reduction of the original scope of work, the adjustment to the contract price shall be calculated based on the work removed, commitments already made, and the relevant provisions set forth in the contract.
- Rescheduling and Extensions
Should the client need to alter a previously confirmed start date or construction schedule, they must contact SC&P CONTRACTS LIMITED as early as possible.
Requests to reschedule are subject to operational resource availability, site access conditions, staffing levels, the availability of plant and equipment, and any relevant contractual requirements.
If a new date is agreed upon, the revised schedule shall be confirmed in writing. Rescheduling may incur additional costs if it gives rise to reasonable and recoverable expenses—such as those related to supplementary site mobilization, transport, the redeployment of plant and equipment, or other commitments arising from prior bookings.
In the event that a project cannot proceed as scheduled due to a lack of site access, failure to provide necessary site information, or the client’s inability to complete required preparations, both parties shall consult to determine a new, feasible date and clarify any associated costs arising under the contract.
7. Changes to Site Conditions and Project Requirements
The client must provide accurate and relevant information regarding the site, access restrictions, known ground conditions, existing drainage facilities, and any other matters reasonably necessary for the execution of the agreed-upon works. Should actual site conditions or project requirements differ materially from the information upon which the quotation was based, SC&P CONTRACTS LIMITED reserves the right to request a reassessment of the scope of work, project schedule, and pricing before proceeding with the relevant tasks.
Where required by the contract, any resulting adjustments to the contract price or completion schedule must be documented via a written change order.
If the parties are unable to reach an agreement regarding the proposed changes, the affected work may be suspended (to the extent reasonably necessary) while the parties determine how to proceed with the contract. Any resulting cancellation or termination shall be handled in accordance with the contract and applicable law.
- Cancellation of Plant and Equipment Hire
Cancellations or modifications to the hire of plant and equipment are subject to the agreed-upon hire period, collection or delivery arrangements, deployment commitments, and the terms of the applicable hire agreement.
If the client cancels the hire prior to the commencement of the agreed-upon hire period, the amount payable shall be determined based on the agreed cancellation terms and any reasonable costs actually incurred, in compliance with applicable law.
If the plant or equipment has already been delivered, allocated, deployed, or otherwise prepared for the agreed-upon hire period, the client may be liable for costs incurred during the period of supply, as well as other recoverable contractual costs.
Requests by the client to extend the hire period, return equipment early, or exchange hired equipment are subject to availability and require written confirmation regarding revised hire charges and collection arrangements.
The client remains obligated to comply with the applicable hire agreement until the agreed-upon end date or such other valid termination date as may be confirmed.
- Delays and Changes Caused by the Company
Should SC&P CONTRACTS LIMITED need to alter established dates or arrangements due to factors such as human resource availability, equipment accessibility, site conditions, weather, transport disruptions, or other operational circumstances, we will notify the client as soon as is reasonably practicable.
Where appropriate, both parties shall consult to discuss a revised schedule or alternative arrangements.
In the event that the Company is unable to perform the agreed-upon services, leading to the termination of the contract, any payments relating to uncompleted work shall be handled in accordance with the contract and applicable law. For work already completed or services already rendered, the Company reserves the right to retain payments already received or to issue invoices for such portions, subject to the terms of the contract and applicable law.
Nothing in this clause shall limit the client’s right to seek remedies in the event that the Company fails to fulfill its contractual obligations and is held liable under the law.
- Refund Processing
Where a refund arises due to a mutually agreed-upon cancellation, a reduction in the scope of services, or other qualifying circumstances, the refund amount shall be calculated in accordance with the contract and applicable law.
Once the refund amount has been confirmed by both parties and the refund process has been authorized, funds will typically be returned to the client’s original payment account within 5 to 10 business days. The actual time required for the funds to appear in the account may depend on the client’s bank or payment service provider.
Should additional information or a contractual assessment be required to determine the refund amount, we will inform the client of the outstanding requirements and proceed with the refund once the amount has been finalized.
This clause does not limit any statutory refund rights to which the client may be entitled under applicable law.
- Client Cooperation and Outstanding Payments
The client is required to provide the information, approvals, site access, and instructions reasonably necessary for the execution of the agreed-upon services.
If the client fails to provide the necessary information, site access, or payments as stipulated in the contract, SC&P CONTRACTS LIMITED reserves the right to take measures permitted under the contract to address the situation—including, to the extent permitted by the contract and applicable law, suspending the relevant work or revising the project schedule. Any outstanding balance shall be calculated based on the agreed price, work completed, services rendered, authorized changes, and any other amounts payable under the contract.
The client remains obligated to pay any undisputed amounts in accordance with the agreed payment terms. Should there be any dispute regarding an amount, it must be raised promptly in writing, with sufficient detail provided to allow for a review of the matter.
- Statutory Rights and Governing Law
This policy shall be interpreted in accordance with the law governing the relevant contract, which may include the law of Northern Ireland, where applicable.
Where mandatory consumer protection legislation applies—including relevant consumer regulations in the United Kingdom and applicable consumer protection rules from the European Union—nothing in this policy shall exclude or limit any rights that cannot be excluded or limited by law.
A consumer’s right to cancel a contract may depend on the client’s status, the nature of the contract, the location where the contract was concluded, and whether the agreement concerns services, equipment rental, or a combination thereof.
To the extent permitted by applicable law, business clients shall be bound by the terms of the business-to-business (B2B) contract agreed upon by the parties.
Nothing in this policy shall exclude any rights or remedies granted by mandatory applicable law.
- Disputes and Communication
Should you have any concerns regarding service cancellations, changes in requirements, refunds, or charges, please contact us in the first instance at projects@scpearthworks.com.
Please provide the relevant project number, quotation number, or invoice number, along with a detailed explanation of the issue and any supporting correspondence or documentation.
Both parties shall make reasonable efforts to resolve such matters through written communication and negotiation. If an agreement cannot be reached, either party may seek remedies in accordance with the applicable contract and law, including, where necessary, initiating legal proceedings in a court of competent jurisdiction.
